HOY I Republic Washington Bureau WASHINGTON Sen. Dennis lfeConcini, a key undecided vote on ijSppreme Court nominee Robert (HPork, told President Reagan on IKyiday the nomination is in "deep bfiouble." JThe Arizona Democrat left a jSjI-hiinute meeting with Reagan in Oval Office on Friday morning Ifsjying he was not swayed by the president's appeals and remained Undecided on how he will vote. 4 IDeConcini plans to make a 0cision this weekend and an-y'jiounce it Monday.

Reagan also met Friday with ESlns. J. James Exon, KRj)bert Stafford, and John llteinz, R-Pa. i-IDeConcini, one of three remain-hxtfc" undecided Senate Judiciary gCpmmittee members, dismissed that Reagan wanted jhim to announce in favor of Bork to gdffset two damaging days as four Nforoderate Senate Democrats from KQie South and one moderate Re-Vpliblican, Sen. Arlen Specter of Pennsylvania, came out against the plgi-year-old federal appellate judge.

Eight more Democrats announced their opposition Friday. -am ginK to make (my decision on what I think is right and '-what my conscience tells me and the kudos from those who p'rjink it's right and the bricks from ythose who don't," DeConcini said. called his decision a "no-win" apolitical situation and said Reagan rC partly at fault for casting the nomination in political terms when he sent it to Capitol Hill in July. Asked if the president was discouraged, DeConcini said, "I think they're (the administration) turned on. I think they think they are going to win." DeConcini said after his meeting with Reagan, "I told the president that I think the Bork nomination is in deep trouble, notwithstanding what my decision might be." He said Reagan did not respond to his gloomy assessment.

McCain said Bork is committed to "ensuring that the Constitution is applied fairly and rationally to all Americans." Reagan focused his discussion with DeConcini on the areas that remain of greatest concern to the senator, DeConcini said. He told Reagan the "nagging problems" he has with the jurist involve Bork's refusal to recognize a constitutional right to privacy and his since-modified position that the Constitution's equal-protection clause does not apply to women. Bork earlier this year said the reach of the equal -protection clause should be limited to racial and ethnic disparities and not extended to differences between the sexes. But he shifted his position in testimony before the Judiciary Committee, saying the clause should apply to everyone.

DeConcini said he told Reagan in explaining his concerns about Bork, "I've been with you on a lot of issues, and I am not out against you just to be against you." Positions generally follow party lines in the enate, where Democrats hold 4-46 edge.

Exceptions are Republi-ean Bork opponents Arlen Specter of Pennsylvania and Robert Pack-wod of Oregon, and Democratic Bork supporters Boren and Ernest Hollings of South Carolina. Reagan, during a ceremony proclaiming "German-American Day," stitched into a speech about U.S.German relations a new plea for Bork's confirmation, saying "there have been a lot of misstatements spread around" about the 60-year-old jurist. "Those who have been distorting must be so long by now." Reagan again blamed "special interests," whom he did not identify, for Bork's problems. "A few special interests consider the courts their private preserve," he said. "Communities all over the nation have seen bow these special interests get through the courts what they can't through the ballot box.

Now the special interests are determined to pack the Supreme Court and to distort the reputation of anyone who disagrees. "This is no longer a battle over the most qualified man nominated in a century is confirmed to the Supreme Court. At 'stake here is the integrity and independence of the American system of justice." White House spokesman Marlin Fitzwater said the president will devote his weekly radio address today to an appeal for Bork's confirmation. i 11 I fl pijpp 1 Si.
