The Arizona Republic A Graham County rancher who is accused of killing nine black bears while protecting his cattle from predators might face criminal prosecution, authorities said Tuesday. Although no have been filed, Graham County Attorney Jack Williams said he hopes a plea agreement can be worked out with Eddie Lackner, owner of the Four Mile Ranch near Klondyke, by this weekend.

"I think something is going to be worked out to make sure the law is followed and that people are satisfied with the result," Williams said. Under Arizona law, bears and cougars are considered big-game animals, but stockmen are permitted to kill them without permits when they attack livestock. A Mass is scheduled for Thursday at 10 a.m. at the church. Interment will take place at St. Francis Cemetery. Judge Cordova, a Phoenix native, was appointed to the federal bench by then- Carter in 1979 and retired in 1984 after a stroke.

Before serving on the federal bench, Judge Cordova had been appointed a Superior Court judge in 1965. He was elected to the same post a year later. He resigned from the state court bench in 1967 and returned to private practice until his appointment to the federal bench. The son of a Mexican laborer, Judge Cordova was born Dec. 6, 1922, Valdemar A.

Williams said Lackner could be charged with failing to file such a report, a misdemeanor punishable by a maximum fineof $750 and four months in jail. He said he hoped settlement of the case could include an agreement whereby the rancher would seek the assistance of state Game and Fish personnel if he caught bears while trying to trap mountain lions preying on his livestock. For instance, he said Lackner caught a bear two to three weeks ago while trying to trap a mountain lion that had killed one of his calves. He said that the rancher called Game and Fish for assistance and that an officer came to the ranch and tranquilized the bear and later released it.

Lackner could not be reached for comment about the case. Game and Fish investigators began looking into the Graham County case in November after a hunter came across five dead bears, one of them in a trap. Later, the investigators found four more bear carcasses in the area. "Some have assumed this particular rancher was trapping and killing all predators, and I don't think there's evidence (he did so)," Williams said. "The evidence is that" he caught bears and didn't know what to do about releasing them and then dispatched them.

"In this case, it appears Lackner may not have reported some of the bears killed in traps he set for lions that were destroying is cattle. I think he did that in good faith, based on our investigation." Williams said Lackner's ranch abuts the Galiuro Wilderness Area, an area that belonged to the Defenders of Wildlife until recently. Lackner also has grazing permits 011 nearby U.S. Forest Service land, Williams said. Williams said mountain lions are breeding constantly and then seeking new territories: to roam, such as the Lackner spread and other ranches.

Bagley; former major became TV and movie actor The Associated Press, TUCSON Earl S. Bagley, a retired Army major who played a judge in the television series Petrocelli, died Saturday of natural causes at Tucson Medical Center. He was 63. Maj. Contributions, Arthritis Foundation, 711 E. Suite 116, Phoenix 85014. ATLANTA Bobby Dodd, longtime football coach and athletic director at Georgia Tech, died Tuesday afternoon after a battle with lung cancer. He was 79. Coach Dodd had a 165-64-8 record in 22 seasons as Tech's head football coach.

His teams went to 13. bowl games, winning nine. He retired as coach after the 1966 season and as athletic director in 1976. Coach Dodd, who survived a bout with prostate cancer in 1975, was diagnosed: in March as having lung cancer. He often was called the "Old Gray Fox." In 1952, Tech went 12-0, and Coach Dodd was named Coach of the Year by the New York Daily News.

He was the Southeastern Conference Coach of the Year in 1951, when the Yellow Jackets were 11-0-1. Coach Dodd was a nationally recognized quarterback, a basketball co-captain and a letterman in baseball at Tennessee. He joined the Georgia Tech coaching staff in 1931 and was promoted to head coach after the 1944 season. John Nidecker; ex-aide to Nixon and Ford ROCKVILLE, Md. John E.

Nidecker, a former special assistant to then-Presidents Nixon and Ford, died Monday of cancer at the age of 75. He became Nixon's deputy special assistant for congressional affairs in 1969 and remained on the White House staff after Nixon resigned in 1974, working for the Ford administration until 1975. During an investigation of South Korean influence peddling in Washington in 1976, it was disclosed that Mr. Nidecker had received $10,000 and other gifts from Korean officials in 1974. He turned the gifts over to the appropriate authorities and was not accused of any wrongdoing.

The Philadelphia native was educated at the Marine Corps Institute and LaSalle Extension University and served in the Marine Corps from 1936-1940. J.C. Holbrook; manager of Baltimore Opera BALTIMORE Jay Collins Hol- brook, general manager of the Baltimore Opera, died Sunday at St. Joseph's Hospital in Towson, Md. He was 35 and lived in Lutherville, Md.

His mother, Ruth Holbrook, said he died of lymphatic cancer. Mr. Holbrook was born in Baltimore and graduated cum laude from the University of Maryland in 1973. He began his association with the Baltimore Opera in 1974 and was director of public relations and assistant general manager before being named general manager in 1980. Mr.

Holbrook also was on the board of advisers of the Metropolitan Opera Regional Vocal Auditions and had been an adviser to the National Institute for Musical Theater and a member of the board of Opera America. William Hutt; economist attacked apartheid IRVING, Texas William H. Hutt, an economist who championed. free enterprise and attacked South Africa's apartheid system of racial separation, died Sunday at age 89. Mr.

Hutt, a native of London, wrote 12 books and numerous scholarly articles, many of which criticized the theories of John Maynard Keynes, which encourage government deficits. and more government control over the economy. After graduating from the London School of Economics in the 1920s with a doctoral degree, Mr. Hutt served as a pilot in the Royal Air Force during World War II. He taught at the University of Cape Town in South Africa from 1926 until 1965 and was a leading critic of apartheid.

His book Economics of the Color Bar is considered a classic in the field of economics and race relations. Mr. Hutt came to the United States in 1965. He lectured extensively and served as professor emeritus at the University of Dallas after his retirement in the early 1980s. which included the post of communications analyst at Fort Huachuca.

Survivors include his wife, Eunice, of Tucson; a daughter, Deborah J. Bagoy-Oberto of Tucson; son, Bruce Earl of Tucson; a brother; and three grandchildren. A service will be held today at 9 a.m. at the main post chapel of Fort Huachuca, followed by burial in the Fort Huachuca Military Cemetery. Daniel R.
