As Mitchell pecked over the top of a stairway, the sheriffs spokesman said, "the gun discharged as a total surprise" to the 16-year-old boy. The bullet hit Mitchell's right cheek, Kimball said. Bleeding profusely, Mitchell ran from the house and was aided by a neighbor. Shirley Fagin, who lives with her husband, Ronald, at the house where the shooting occurred, told police the loaded gun had been left on the bedroom floor because she did not expect anyone to be in the house while she was at work, Kimball said.

Charges against Alan Eve, 37, who worked as a bookkeeper and office manager at a Phoenix metal-plating firm, were dismissed on request by the prosecution, which said Eve's physical condition was not a factor in the decision. Two other defendants, including Eve's older brother, pleaded guilty Monday to charges of reckless disposal of hazardous waste and could receive maximum 22-month prison terms when sentenced April 14 by Judge Jeffrey Cates of Maricopa County Superior Court. Ronald Eve, 39, told Cates that he did not plead guilty in order to get his quadriplegic brother off the hook. Alan Eve, who is confined to a motorized wheelchair, did not attend the court hearing, but his attorney, Charles McNulty, said he does not believe that charges should have been filed against the paralyzed man. Marty Woelfle, an assistant attorney general, said she asked Cates to drop the charges against Alan Eve because of evidence obtained by her office showing he was not a "key employee" at Magic Metals Plating, formerly of 3632 W.

Whitton Ave. Woelfle said she knew that Alan Eve was confined to a wheelchair when a state grand jury indicted him and the other two defendants on April 25, but explained that she did not believe his physical condition was "relevant" to the case. Alan Eve, Ronald Eve and Michael Charles Clark, 35, each charged with three counts of intentional disposal of hazardous wastes and one count of endangerment, all stemming from the' firm of Magic Metals Plating, which operated for about 10 years before going out of business in early 1987. Woelfle filed court papers alleging that the crimes were "dangerous," thus subjecting the three men to mandatory prison terms of as much as 9'i years, if they were convicted. Ronald Eve and Clark, both of Phoenix, pleaded guilty after striking a plea bargain in which Woelfle agreed to drop the "dangerous" allegation.

Under the plea bargain, they can receive sentences ranging from probation to 22 months in prison. The two defendants also agreed to pay as much as $84,259 in restitution to compensate their former landlord at the Magic Metals Plating property for the cost of a cleanup operation. The former business applied metal coatings to objects, such as chrome to car bumpers. The plating process involved the use of acidic and caustic liquids as well as solutions containing lead, nickel, chromium and cadmium. The indictment alleged that the three defendants violated the state Solid Waste Disposal Act by abandoning hazardous wastes inside and outside Magic Metals Plating from May 1 through May 22, 1987.
